Terms of Use

1. Acknowledgement

You and the developer of VoiceToMD ("the Developer") acknowledge that these Terms of Use are concluded between you and the Developer only, and not with Apple. The Developer, not Apple, is solely responsible for the VoiceToMD application ("the App") and the content thereof. These Terms of Use may not provide for usage rules for the App that are in conflict with the Apple Media Services Terms and Conditions as of the Effective Date.

2. Scope of License

The Developer grants you a limited, non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

3. Description of Service

VoiceToMD is an iOS application that captures voice notes, transcribes them on-device using machine-learning models running on the Apple Neural Engine, optionally identifies multiple speakers, and routes the resulting markdown files to destinations you configure (such as iCloud Drive, email, webhooks, SFTP servers, or iOS Shortcuts).

VoiceToMD does not require an account. The App makes no transcription API calls. Audio is processed entirely on your device. No transcript content, audio, or destination credentials are transmitted to the Developer.

4. Subscription Terms

The App is offered with a free tier and an optional paid Pro subscription.

Pro subscription products:

  • VoiceToMD Pro — Monthly at $2.99 USD per month (or local equivalent)
  • VoiceToMD Pro — Annual at $29.99 USD per year (or local equivalent)

Free trial. A 7-day free trial of Pro is offered on first purchase of either Pro product. Any unused portion of the trial is forfeited if you purchase a subscription before the trial ends.

Billing. Payment is charged to your Apple ID account at confirmation of purchase. All billing is handled by Apple via the App Store; the Developer does not receive or store your payment information.

Auto-renewal. Pro subscriptions automatically renew at the end of each subscription period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period at the price of the chosen subscription.

Managing and cancelling. You can manage your subscription, change your subscription product, or turn off auto-renewal at any time by going to your Apple ID account settings on your device (Settings → [your name] → Subscriptions). Deleting the App does not cancel your subscription.

Refunds. Refund requests are handled by Apple in accordance with Apple's refund policies. The Developer cannot issue refunds directly.

Price changes. The Developer may change subscription prices in accordance with Apple's policies. You will be notified of any price increase before it takes effect, and you may cancel before the change applies.

5. Recording Laws and Consent

Recording laws vary substantially by jurisdiction. Some jurisdictions require the consent of all parties to a recorded conversation; others require only one party. Some require visible or audible notice. Some prohibit certain recordings outright.

You are solely responsible for understanding and complying with all laws applicable to your use of the App, including any laws governing the recording of conversations, telephone calls, meetings, public spaces, or any other audio. This includes obtaining any required notices to, and consent from, other persons whose voices may be captured by the App.

The Developer makes no representation that your use of the App is lawful in your jurisdiction and provides no legal advice. If you are uncertain whether a recording you intend to make is lawful, consult an attorney before making it.

6. Acceptable Use

You agree to use the App only for lawful purposes.

You agree not to:

Anti-surreptitious-recording. The App is intended for recording your own thoughts, dictation, conversations you participate in with appropriate consent, and other lawful personal use. Covert, surreptitious, or unlawful recording is a material breach of these Terms. The Developer may, without limiting any other remedy, terminate your license to use the App for any breach of this Section.

7. User-Configured Destinations

The App allows you to configure destinations for your transcripts and audio files, including iCloud Drive folders, email recipients, webhooks, SFTP servers, and iOS Shortcuts.

Once your content leaves the App via a destination you have configured, it is no longer under the Developer's control. Your use of any third-party service or system you have configured as a destination is subject to that service's terms of service and privacy policy. The Developer is not responsible for:

You are solely responsible for ensuring that your configured destinations are appropriate for the content you send to them, and that you have the right to send content to them.

8. Your Content

You retain all rights, title, and interest in and to the audio you record, the transcripts produced by the App, and any other content you create using the App. The Developer claims no ownership of, license to, or right to access your content.

9. Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You and the Developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

10. Disclaimer of Warranties

The Developer does not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that transcription output will be complete, accurate, or suitable for any particular purpose.

The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Developer's sole responsibility.

11. Product Claims

You and the Developer acknowledge that the Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. These Terms may not limit the Developer's liability to you beyond what is permitted by applicable law.

12. Intellectual Property Rights

You and the Developer acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

13. Third-Party Components and Services

The App incorporates and depends on third-party components and services, including but not limited to:

The Developer is not responsible for the functionality, accuracy, availability, or terms of any third-party component or service. Your use of features that depend on third-party services may be subject to those services' terms.

14. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the App. For example, you must not be in violation of your wireless data service agreement when using the App.

15. Limitation of Liability

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in which case the above limitations apply only to the maximum extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless the Developer from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

18. Third-Party Beneficiary

You and the Developer acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

19. Termination

These Terms remain in effect until terminated. Your rights under these Terms will terminate automatically without notice if you fail to comply with any provision. Upon termination, you must cease all use of the App and delete it from your devices. Sections 5, 6, 7, 8, 10, 11, 12, 15, 16, 17, 18, and 20 survive any termination.

20. Governing Law

These Terms are governed by the laws of the State of Texas, United States of America, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App will be resolved exclusively in the state or federal courts located in Texas, and you consent to the jurisdiction of those courts.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

21. Changes to These Terms

The Developer may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the date of the most recent change. Material changes will be communicated through the App or on this page. Your continued use of the App after the effective date of any change constitutes your acceptance of the updated Terms.

22. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect. These Terms, together with the Apple Licensed Application End User License Agreement and the VoiceToMD Privacy Policy, constitute the entire agreement between you and the Developer regarding the App.

23. Age Requirements

You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you must have the consent of a parent or legal guardian to use the App and to agree to these Terms.
